Psyvids respects intellectual property rights and expects our users to do the same. This policy outlines our procedures for responding to notices of alleged copyright infringement pursuant to the Digital Millennium Copyright Act of 1998 ("DMCA").

1. DMCA Notice Requirements

To file a copyright infringement notification with us, you must send a written communication that includes substantially the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. How to Submit a DMCA Notice

Note: If you knowingly materially misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees.

3. Counter-Notice Procedures

3.1 Requirements

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice including:

  • Your physical or electronic signature
  • Identification of the material that has been removed
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located
  • A statement that you will accept service of process from the person who provided notification of the alleged infringement

3.2 Processing Time

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us of legal action within 10-14 business days, we may restore the removed content.

4. Repeat Infringer Policy

We maintain a policy to terminate account holders who are repeat infringers. A repeat infringer is a user who has been notified of infringing activity multiple times and/or has had content removed from the service multiple times.

5. Content Removal Process

5.1 Initial Review

  • We review each notice within 1-2 business days
  • Content may be temporarily disabled during review
  • Both parties are notified of our actions

5.2 Restoration Process

  • Content may be restored after counter-notice waiting period
  • Both parties are notified of restoration
  • Appeals process available for disputed decisions

6. Fair Use

Before submitting a DMCA notice, please consider whether the use of your copyrighted material may qualify as fair use. Fair use principles include:

  • Commentary and criticism
  • Parody and satire
  • News reporting
  • Teaching and education
  • Research and scholarship

7. Modifications to Policy

We reserve the right to update this DMCA Policy at any time. We will notify users of any material changes through our website or other communication channels.
